In the long term, this can even\u00a0<strong>Strengthening trust<\/strong>, as employees experience that suggestions are taken seriously \u2013 regardless of who makes them.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-af74007 elementor-widget elementor-widget-heading\" data-id=\"af74007\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">The external reporting channel: What happens if internal anonymous reporting is not possible?<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-28f3800 elementor-widget elementor-widget-text-editor\" data-id=\"28f3800\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Whistleblowers are not limited to internal reporting offices<a href=\"https:\/\/www.hinweisgeber-system.info\/hinweisgeberschutzgesetz-hinschg\/%C2%A7-19-errichtung-und-zustaendigkeit-einer-externen-meldestelle-des-bundes\/\">\u00a7 19 et seq.<\/a><a href=\"https:\/\/www.hinweisgeber-system.info\/hinweisgeberschutzgesetz-hinschg\/%C2%A7-19-errichtung-und-zustaendigkeit-einer-externen-meldestelle-des-bundes\/\" target=\"_blank\" rel=\"noopener\">\u00a0HinSchG<\/a>limited.<br \/>When internal channels do not allow anonymous reporting or are not trusted, the\u00a0<strong>external reporting channel<\/strong>\u00a0open.<\/p>\n<p>In this case:<\/p>\n<ul>\n<li aria-level=\"1\">the identity of the whistleblower remains protected from the company<a href=\"https:\/\/www.gesetze-im-internet.de\/hinschg\/__8.html\" target=\"_blank\" rel=\"noopener\">\u00a7 8 HinSchG<\/a>)<\/li>\n<li aria-level=\"1\">Authorities receive early notification<\/li>\n<li aria-level=\"1\">In the further course of events, investigative authorities are involved<\/li>\n<\/ul>\n<p>For companies, this means: foregoing internal anonymous reporting increases the likelihood\u00a0<strong>External escalations<\/strong>.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-51fb17f elementor-widget elementor-widget-heading\" data-id=\"51fb17f\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Confidentiality, Documentation and GDPR: Why simple solutions are not enough<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-e6f98e1 elementor-widget elementor-widget-text-editor\" data-id=\"e6f98e1\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>The Whistleblower Protection Act obliges companies to:<\/p>\n<ul>\n<li aria-level=\"1\">strict confidentiality (\u00a7 8 HinSchG)<\/li>\n<li aria-level=\"1\">full documentation of all processing steps<\/li>\n<li aria-level=\"1\">for tamper-proof storage for at least 3 years (see.\u00a0<a href=\"https:\/\/www.gesetze-im-internet.de\/hinschg\/__11.html\" target=\"_blank\" rel=\"noopener\">\u00a7 11 HinSchG<\/a>)<\/li>\n<\/ul>\n<p>Access is exclusively permitted to those with the\u00a0<strong>Reporting office\u00a0<\/strong>trusted individuals.<\/p>\n<p>The HinSchG also requires that reports include all procedural steps\u00a0<strong>available at any time<\/strong>\u00a0(spoken digitally) recorded and kept for at least three years. Even during this period, only the reporting office, i.e. a very\u00a0<strong>small group of people<\/strong>\u00a0(two or three people), have access to the documentation. Simple solutions such as email mailboxes, local drives or internal collaboration tools are legally permissible overall, but regularly do not meet the requirements of the GDPR.<\/p>\n<p>There is a significant risk of data protection breaches here:<\/p>\n<p>\u00a0Too many people have access via internal IT, local servers, or the organisation's cloud servers\u00a0<strong>Access\u00a0<\/strong>on confidential information.<\/p>\n<p>However, in this case, the regulations of the HinSchG do not apply, but rather the GDPR, which significantly increases the risk for companies:\u00a0<strong>GDPR fines<\/strong>\u00a0can up to\u00a0<strong>four percent<\/strong>\u00a0of the global annual turnover or\u00a0<strong>20 million euros<\/strong>\u00a0amount to<a href=\"https:\/\/dsgvo-gesetz.de\/art-83-dsgvo\/\" target=\"_blank\" rel=\"noopener\">Article 83(4)\/(5) GDPR<\/a>and thus lie significantly above the sanctioning framework of the HinSchG.<\/p>\n<p>Unlike internal email or SharePoint solutions, digital whistleblower solutions offer tamper-proof proof that only authorised individuals had access to the content of the reports.
